Drivers getting disqualified

Don't know how you think there's a lawsuit coming. Sounds like the contractor's there are running around scared. Scared contractors don't sue. Hell, they don't push back at all.

The suit would be on behalf of the drivers, and Fred would shift it over to the contractors. Remember the bus that I've mentioned before? It's heading directly toward you at 70 mph and your back is turned. Please remember this. Never trust Fred S or FedEx. Protect yourself as best you can.

As long as courts hold the contractor/ISP model to be legitimate, Fedex won't be liable to the drivers. Notice how the cases have all been between contractors and Fedex?

If the drivers are getting the shaft from FedEx, they need to go after FedEx, because they have wrested control away from the contractor and decided to discipline and disqualify drivers themselves. FedEx is all about absolute control. You don't believe it, but that's the way Fred rolls, and has rolled, for a very long time. Over time, you're going to continue to see your influence and control diminished as FedEx takes over.

In effect, there is no agreement between the company and the drivers "getting the shaft". If Fedex has "wrested control away from the contractor" what court is going to listen to a driver's complaint about that? A driver would have no standing whatsoever.

If a court rules that FedEx has exceeded the degree of control that deliniates the boundary between contract driver and employee, the whole ball game changes. It sounds to me like FedEx is routinely taking-over the role of the contractor when it comes to the issues of discipline and driver qualification. For now, you're right, but I think things are going to change.

FedEx is all-encompassing, and they won't be able to stop sticking their corporate nose into affairs that belong with the contractor. They will violate their own agreement(s).
