How can RPCDs be laid off on Tuesday when the language says they can't be while 22.4s are working in the building?

22.4s are scheduled to work Wednesday thru Sunday come January. No (0) Zero 22.4s will be working Mondays or Tuesdays therefore unlimited RPCDs can be laid off M and T.

C'mon. Really? Why is that so difficult to comprehend?

Why won't those who are familiar with the grievance and arbitration process admit this horrible language will fail at hearings and ultimately at arbitration?

How will Tuesdays volume dry up when 22.4s haven't delivered since Sunday?

Your sky is falling scenario is a little extreme. Sorry

Also what about pick ups? Do those disappear also?

They can't.

"It is the commitment of the parties that RPCDs work a Monday through Friday schedule."

"The number of protected RPCD jobs in each building as outlined in this Article 22.4 (1) above, shall be guaranteed from replacement by 22.4 combination drivers or from any part-time drivers as allowed by any Supplement, Rider or Addendum."

"No RPCD shall be laid off or displaced from the classification while 22.4 combination drivers are working in the building.

please enlighten me as to where RPCDs who are laid off on M and T are guaranteed more than 24 hours.

"There shall be a weekly guarantee in each center as follows: In each classification in each center, the most senior ninety percent (90%) of employees called or put to work on the first (1st) workday shall be afforded the opportunity of working forty (40) hours of straight- time work during the week."

You just are too much of a coward to admit it.

Name calling.... really ?

OK.

You know it's piss poor language purposely written to guarantee ALL 22.4s 40 hours per week while having the right to only work RPCDs W Th friend. 8 hour guarantee x 3 days = 24 hours guaranteed for ALL RPCDS.

Your lack of knowledge.... is embarrassing to Local 243.

How are "your" NLRB charges going ?

I always notice (when you refer to them) as "our" charges.... or "we".

Why isn't TDU or OZ, all over this travesty of a contract blunder ?

It would be a rallying cry for them, if true.

Come on bud. Much of the dissention was about the 22.4 jobs "created". You know this.

The truth never changes.
Never question Big Union Man. He works tirelessly for the membership. He would do it for free if they would let him. Lol.
The facts get obscured and twisted as time goes on. Not that anything on here matters (and is more times than not someone's opinion) posting and dealing with the truth is working tirelessly for members of the union. Watching the corruption built on falsehood and dishonesty crash and burn in Chicago is not only demeaning for honest members of the union it is also a relief to them as well.
Tell the truth (as we understand it), fix the problems as we go and the union will have more respect from not only those outside of it but more importantly the members who have been trampled on to the point of non involvement in non right to work states. After a while you learn to ignore Hoffa cheerleaders on here. You can always put people on ignore.

BUG knows the 90% of RPCDs put to work on the 1st workday language (Monday) is garbage. Yet, he keeps bringing it up solidifying my point.

The union created a 40 hour guarantee for 100% of 22.4s.

Obviously, the union should have negotiated a change in the RPCD language from the 90% of RPCD # (which is drastically reduced on Mondays due to routed being cut because of Saturday and soon Sunday ground).

The language absolutely should have been changed to 100% of RPCDs shall have the RIGHT to 40 hours per week.

Hopefully these red vested criminals get caught. It is happening at the UAW Director of UAW Region 5, successor to union chief Jones, charged in corruption probe

and it is happening at the Teamsters. Once-powerful Chicago Teamsters boss’s long fall

Only a matter of time until the UPS red vest Hoffasters with Taylor, Hall and rest get caught. tick tock. Soon the bell tolls for thee.

It's only been Central Region language for 40+ years.

In your limited scope of understanding, you don't even know where it came from.

Who gives a rats behind if the 90% guarantee has been in the Central Language for 40 years? It is irrelevant. What is relevant is that the Red Vesters found a way to guarantee 40 hours per week to 100% of the 22.4 drivers.
All 22.4 combination drivers shall be guaranteed eight (8) consecutive hours of straight time pay per day, if reporting as scheduled. All 22.4 combination drivers shall work a five (5) consecutive day schedule of Tuesday through Saturday or Wednesday through Sunday. This paragraph shall supersede any Supplement, Rider, or Addendum on the same subject.

Now that 90% of RPCDs total is reduced because of Saturday Ground resulting in less routes being built on Mondays. 90% of the NOW lower number of drivers working Monday are guaranteed 40 hours.

. ..the most senior ninety percent (90%) of employees called or put to work on the first (1st) workday shall
be afforded the opportunity of working forty (40) hours of straight time work during the week.

Your refusal to acknowledge the fact that Hoffa/Hall/Taylor and many locals foolishly/purposely omitted a 40 hour guarantee for RPCDs is very telling. Keep towing that line.

100% of 22.4s (ALL) are guaranteed 40 hours per week yet only 90% of the RPCDs working Mondays (which in reality is about 65 to 75% of all RPCDs in a center) are guaranteed 40 hours.

It appears that you do not have the capacity to understand this very simple purposively written garbage language.
Or you are afraid to admit that the 22.4 forty (40) hour guarantee is an absolute 40 hour guarantee. The 22.4 language has no grey area; the 90% garbage language should have been changed to 100% (ALL) RPCDs have the right to a 40 hour guarantee.

Why would Hoffasters create a brand new classification with a 40 hour guarantee without 1st granting all current full time package car drivers that same right?

Red Vested criminals like BRF will not be permitted to continue betraying members and colluding with UPS. Piece of garbage leaches will eventually be flushed out.

It's a shame it has gone on for as long as it has.

The Hoffa Hall Taylor regime is not only culpable, they condone this behavior.

BRF is only one of the many corrupt Teamsters that have no business "representing" UPSers.

The depth of your ignorance, regarding the contract.... is amazing.

"RPCDs working a Monday through Friday schedule shall be guaranteed five (5) consecutive days of eight (8) consecutive hours per report and forty (40) straight time hours of straight time pay each week, if reporting each day as scheduled, as long as work is available."

"No RPCD shall be laid off or displaced from the classification while 22.4 combination drivers are working in the building."

You are still refusing to comprehend the language your cronies crafted.

"No RPCD shall be laid off or displaced from the classification while 22.4 combination drivers are working in the building."

Here is the problem with that language. UPS is going to a 22.4 schedule of Wednesdays thru Sundays therefore 0 (ZERO) 22.4 will be working in any building on M and T. RPCDS will not be displaced from their classification.

RPCD Language: if reporting each day as scheduled, as long as work is available
22.4 Language: All 22.4 combination drivers shall be guaranteed eight (8) consecutive hours of straight time pay per day, if reporting as scheduled

The UPSers in Local 243 repeatedly asked UPS and the 243 Local leaders for clarification regarding RPCDs who are laid off on a Mondays or Tuesdays.

We asked if RPCDs (laid off on M and/or T) had the right to work Saturday and/or Sunday in order to reach 40 hours. The answer continually told by both the local union and UPS was "we don't know".

Finally after months of UPSers looking for a concrete answer; we got one. Right before the 3rd supplemental vote.

The answer from the Union and UPS was a resounding NO; an RPCD has no right to work a Saturday or Sunday and no right to 40 hours during the week.
As you already stated; the only RPCDs guaranteed 40 hours are the top 90% working the 1st day of the week which is Monday for RPCDs. With the advent of Sat and soon Sun ground; the # of routes and drivers working Mondays has been drastically reduced. And more RPCDs are being laid off on Mondays.

The result of a grievance filed on this subject most likely be denied. The company and local have already agreed on the interpretation of the language. If the grievance is allowed to be appealed to the final step; This applies: If any grievance or dispute cannot be satisfactorily settled by a majority decision of the panel and the UPS Joint Area Committee, then the grievance shall be submitted to the United Parcel Service Vice President of Labor Relations, or his/her designee, and the International Director of the Central Region of Teamsters, or his/her designee.

The local and UPS have already agreed on the intent of the language and the fact that the interpretation is based on the essence of the contract.

In other locals or supplements; Arbitration is included. As you know; an arbitrators decision(award) must also draw its essence from the parties collective bargaining agreement. which is: It is the commitment of the parties that RPCDs work a Monday through Friday schedule.

In case you did not read further up the post: Local 243 leaders and UPS Labor have informed RPCDs that (other than the top 90% of the reduced M # working) they have no right to 40 hours. Period.

Have you been a party to similar collusion between Teamster leaders and UPS labor? Do you know of other Local Teamster officials targeting of UPS Teamsters' livelihoods? Has there been a memo sent out regarding being smarter when retaliating against members so as not to get caught?

I believe you have considerable knowledge regarding the betrayal of the members thru retaliation, targeting and collusion.

Its only a conspiracy theory until it is not. Rob A's was a conspiracy theory until concrete proof of actual email between BRF and UPS Labor proving retaliation and collusion was obtained.

Let's see.... your documentation.

From 243 Mirror Newsletter: " Our issues revolved around protecting seniority, addressing Article 22.4 combination jobs and making sure that members required to get an Airport badge are compensated for their time. " “Since UPS agreed to two of our three major open issues, we recommended a YES vote the third time around.” The third vote was a mandated hall vote. It was standing-room only at the Michigan Conference of Teamsters Welfare Fund on Sunday, April 28th"

OK
The 3 issues were
1. Allowing days off by Seniority when over staffed.
2. Allowing RPCDs the right to 40 hours by either working 4 ten hour days or allowing the right to work Saturdays and or Sundays.
3. Getting paid for time spent obtaining Airport Badges.

Paid for time while obtaining an Airport badge and Protecting seniority by allowing days off when overstaffed by seniority is what 243 accomplished. What a joke.

The 2 out of 3 the Teamsters "achieved" pale in comparison to what we lost by not guaranteeing RPCDs rights to 40 hours.

Editorial: A strike that shouldn't have happened

And.
Accused UAW thief advising on worker deal with GM
Criminal colluding pieces of garbage at the UAW and Teamsters.

Our union would never join with UPS to target a member, right?

Look no further than BRF colluding with UPS Labor Management. She literally was caught red handed attempting to facilitate the termination of a 20+ year Package Car Driver. Hoffaster by the dozens have colluded with UPS. All the way up to Hall, Taylor and Hoffa. Our dues are lining these friend,s pockets.

The Teamster and UAW colluders are real pieces of work.
